PRISON (AMENDMENT) ACT, 2026

ENACTED by the Legislature of Anguilla

PRELIMINARY

Amendment to section 7 of the Prison Act

1. The Prison Act, R.S.A. c P75 is amended in section 7 by deleting the phrase “male”.

Validation of actions of female prison officers

2. Anything done by a female prison officer—

  • (a) pursuant to the powers and authority given under section 7; and
  • (b) prior to the commencement of this Act;

shall be deemed to have been lawfully done by the female prison officer.

Citation

3. This Act shall be cited as the Prison (Amendment) Act, 2026.

OBJECTS AND REASONS

(The objects and reasons do not form part of the Bill)

This Bill amends section 7 of the Prison Act to provide that all officers, (both male and female) shall have the powers, authority, protection and privileges of a police officer. This is achieved by removing the reference to “male” in this section. The Bill also validates anything done by a female prison officer under section 7, prior to the commencement of this Bill.
